Minerals Coverage Update
As reported in a recent Breaking News, TDI held a Minerals Coverage Hearing on July 15. At the conclusion of the hearing, TDI Commissioner Mike Geeslin placed the hearing into recess for at least 60 days and asked that all interested parties work together in the interim to seek any possible solutions to the issue. In response to the Commissioner's request, TLTA held a stakeholder's meeting on August 6 and will continue our dialogue with all interested parties. The TLTA staff felt very positive about what the group was able to accomplish by having a thorough discussion of all sides of the issue. The TLTA Minerals Task Force reconvened this week to review the feedback from stakeholders at the meeting and to work on ways to resolve those concerns. They will continue their work with the goal of making a recommendation back to the TLTA Board of Directors in the very near future.

TDI Press Release: TDI Takes Action to Secure United Title
August 7, 2008
AUSTIN – The Texas Department of Insurance (TDI) has placed United Title of Texas under a Hazardous Financial Condition Order after the entity's parent company shut down the operation without notice to regulators, consumers or employees on July 29. The Hazardous Financial Condition Order prevents United Title from releasing any escrow funds without first determining that all funds and files for pending closing are accurately accounted for. Minerals Coverage Hearing Held July 15-- View the Latest TLTA Proposal
At the TDI Minerals Coverage Hearing on July 15, 13 witnesses spoke on behalf of the title insurance industry in support of the TLTA proposal.  Three witnesses from the real estate and legal community provided testimony in opposition to the proposal.  The Office of Public Insurance Council (OPIC) was also present and provided testimony.  Click here to view the latest TLTA proposal.  Please note that the TLTA Board of Directors approved another revision late last week which was submitted at the hearing.  At the conclusion of the hearing, TDI Commissioner Mike Geeslin placed the hearing into recess for at least 60 days and asked that all interested parties work together in the interim to seek any possible solutions to the issue.  In response to the Commissioner's request, TLTA will continue our dialogue with all interested parties.

Minerals Coverage Hearing -- TLTA Files Revised Agenda Items
In preparation for the public hearing to be held on July 15, 2008 at 10:00 a.m. in Room 100 of the William P. Hobby State Office Building at 333 Guadalupe Street in Austin, to consider rules, forms or endorsements regarding minerals coverage,
the TLTA Board of Directors and Minerals Task Force have had several meetings to refine TLTA's position.  The Board voted to revise the originally filed agenda items.  Please note that Stewart Title's originally filed items have been withdrawn and Stewart jointly filed the following agenda items with TLTA.  Click here to review the agenda items.

2008 Biennial Hearing Update
The TLTA Board of Directors met by conference call on May 14 to approve recommendations submitted by the Regulatory Committee on agenda items for the 2008 Biennial Hearing. TLTA will post the agenda items once they are officially submitted to TDI and given an agenda. Most of the items discussed are considered "clean-up" from the 2006 hearing.

TDI Publishes Notice of Call for Agenda Items Relating to the 2008 Biennial Hearing
TDI has published the notice of call for agenda items relating to the 2008 Biennial Hearing. The deadline for submissions is May 26 and it is expected that TDI will schedule the Rate/Rule hearing sometime in early fall.

Commissioner Withdraws Minerals Coverage Bulletin - Schedules Hearing for July 15
TDI Commissioner Mike Geeslin has issued a notice that a public hearing will be held on July 15, 2008 at 10:00 a.m. in Room 100 of the William P. Hobby State Office Building at 333 Guadalupe Street in Austin, to consider rules, forms or endorsements regarding minerals coverage.  Additionally, he has withdrawn in its entirety,
Bulletin #168 dealing with minerals coverage.

- The Texas Department of Insurance (TDI) has issued a bulletin requesting information for the year ending on December 31, 2006. The Title Agent Call System (TACS) remains the same as the 2006 call. You are encouraged to submit your experience electronically using the TACS. Copies of the forms, TACS program and manual can be downloaded from the TDI website.
