TDI PUBLISHES NOTICE OF 2004 Title Insurance Biennial Hearing |
The Texas Department of
Insurance (TDI) has issued notice for the Rulemaking and Ratemaking Phases of
the 2004 Texas Title Insurance Biennial Hearing.
The Rulemaking Phase of the hearing for the consideration of rules, forms and
endorsements and related matters will begin on December 15, 2004 and continue
thereafter at dates, times and places designated by the Commissioner until its
conclusion. The Ratemaking Phase of the hearing for consideration of matters
with rate implications will begin on December 31, 2004. Both hearings will be
held in Room 100 of the William P. Hobby, Jr. State Office Building,
333 Guadalupe Street in Austin.
The TLTA Rates, Rules and Forms Committee and Board of Directors are in the
process of finalizing positions on agenda items that have been filed.

TDI PUBLISHES NOTICE OF SPECIAL HEARING ON P-53 |
The Commissioner of Insurance will hold a public hearing on Tuesday November 2, 2004, at 10:00 a.m. in Room 100 of the William P. Hobby, Jr. State Office Building, 333 Guadalupe Street in Austin, Texas, to consider a request filed by the Title Professionals Association to withdraw Procedural Rule P-53 of the Basic Manual of Rules, Rates and Forms for the Writing of Title Insurance in the State of Texas.
The
Commissioner will also consider whether the Rule should be modified
and will further consider
how to accurately identify,
report, examine and/or contain marketing expenses as they relate to title rate
calculations and violations of article 9.30, including whether such expenses
should or should not be included in the title rate.
The TLTA Rates, Rules and Forms Committee will meet on October 18 to discuss this
issue and will report to the Board of Directors at their meeting in San Antonio
on October 20.

T-37A, P-27 AND STATISTICAL PLAN CHANGES ADOPTED BY TDI |
The Texas Department of Insurance has adopted amendments to the Texas Title Insurance Basic Manual effective November 1, 2004. Amendments include form T-37A, Immediately Available Funds Procedure Agreement (Agent Designation for Federally-insured Lender), which provides for a designated agent of a federally-insured lender as a party to the agreement that defines procedures to make funds immediately available among a financial institution, a title company, and a federally-insured lender in the closing of a mortgage loan. In conjunction with the new form, amendments to procedural rule P-27 (Disbursement from Escrow or Trust Fund Accounts) have been adopted to conform the language of this procedural rule for use with the new form.
The amendment to §9.401 also updates the adopted Statistical Plan. The amendments to the Statistical Plan update the codes and other reporting requirements that have occurred since the last two Texas Title Insurance Biennial hearings.

We would like to convey our deepest sympathy to
George and Cindy Houghton, whose son Andy passed away August 9 as a result of
injuries sustained in Iraq in July. Andy was gravely injured by a Rocket
Propelled Grenade (RPG) while riding in a Bradley fighting vehicle. He was on an
early morning patrol near Samarra, Iraq with his platoon. Services were held on
Monday, August 16, 2004, at the Old Cadet Chapel on the grounds of the West
Point Cemetery. Andy's father, George Houghton is Vice President/South Texas District Manager
of Stewart Title Company in San Antonio.
