2023-2025 Basic Premium Rate Review & Hearing
The 2023–2025 basic premium rate review involved two parallel tracks that stemmed from the same rate-setting process:
- (1) TDI’s administrative rate hearing process, which began in 2023, and
- (2) TLTA’s legal challenge to the Commissioner’s February 2025 order requiring a 10% rate reduction, which was issued as a result of that 2023–2025 review.

Rate Review & Hearing Chronology
This section outlines all actions taken by TDI as part of its administrative rate review and hearing process.
- September 20, 2023 — TDI announces first informal public stakeholder meeting to discuss the basic premium rate on Oct. 26, 2023. This was not a formal proceeding at which decisions were made, but rather an opportunity for interested parties to share data analysis and relevant comments.
- December 12, 2023 — TDI holds second stakeholders meeting, at which TLTA and our team of experts represented the industry and continued to demonstrate to TDI the current gridlocked state of the real estate market and the ongoing increase in industry expenses of all kinds.
- July 9, 2024 — TDI announces that they would hold a hearing to consider a change to the title insurance basic premium rates. This initial hearing was scheduled for September 19, 2024 but canceled.
- October 22, 2024 — TDI holds a public meeting on title insurance rates at which TLTA represented the industry and presented our actuarial report and title rate overview and analysis.
- November 1, 2024 — TLTA formally requests a public hearing under Insurance Code §2703.202 to evaluate title insurance premium rates.
- November 8, 2024 — TDI announces that the hearing would take place on January 21, 2025. However, due to inclement weather, the hearing was postponed and held on January 23, 2025.
- February 6, 2025 — TDI Commissioner Cassie Brown announces 10% basic premium rate reduction effective July 1, 2025. You can review TDI's order here.

Legal Proceedings Chronology
This section provides a step-by-step account of TLTA’s legal efforts to challenge the Commissioner’s February 2025 order. These dates concern court actions and appeals only and are separate from the above TDI rate review process.
- February 26, 2025 — TLTA files Motion to Vacate and Motion for Rehearing and Reconsideration with TDI.
- March 4, 2025 — The Commissioner denies TLTA's motion
- March 6, 2025 — TLTA files an official appeal in the Travis County Court. In addition to a request to overturn the Commissioner’s order. Petition also seeks injunctive relief from the July 1 effective date.
- May 27-28, 2025 — Temporary Injunction Hearing held at the Travis County Courthouse. The court filings related to this hearing can be found in the Notices & Additional Information section below.
- May 30, 2025 — In response to the above hearing, Judge Lyttle of the Travis County Courthouse grants TLTA's request for a Temporary Injunction putting the 10% rate reduction on hold.
- June 17, 2025 — TDI appeals the lower court ruling which moved the case to the 15th Court of Appeals.
- June 20, 2025 — TLTA files a motion for emergency relief with the 15th Court of Appeals.
- June 23, 2025 — TDI responds to TLTA's unopposed request for emergency relief with the 15th Court of Appeals.
- August 21, 2025 — TDI files an appellant's brief, outlining their concerns.
- September 2, 2025 — TLTA is granted 60-day extension to file our appeals brief.
- October 17, 2025 — TLTA's granted further extension. The deadline for filing an Appellee’s brief was extended to Friday, January 9, 2026. Read more here.
- January 2026 — Following the conclusion of the ongoing rate process and the December 19 ruling by TDI, the lawsuit has been dismissed. Read more here.
