TLTA Amicus Letter Update: Texas Supreme Court Grants Petition for Review of Case Involving Correction Instruments

The Texas Supreme Court scheduled oral arguments Dec. 2, 2020 in Broadway National Bank, Trustee of the Mary Francis Evers Trust, et al., v. Yates Energy Corporation, et al. (No. 19-0334). TLTA requested the court's review of this case in an amicus letter filed June 9, and we're pleased to learn that they've granted the petition.  
 
This case is of substantial importance to the everyday practice of real estate law in Texas because it questions how parties may effectively correct an error in the documentation of a conveyance under the Texas Property Code correction provisions. The trial court and appellate court reached different conclusions, and the appellate court was not unanimous in its approach. While TLTA did not advocate for a specific interpretation of these statutes, in an amicus letter submitted to the Texas Supreme Court regarding this case, TLTA respectfully requested that the court provide clear instruction for practitioners working with these statutes on a daily basis.
 
We will continue to monitor the court's review of this case and provide updates when there is news to share. Great job TLTA Judiciary Committee members – your hard work continues to pay off on behalf of our industry and Texas' real estate marketplace.  
 
TLTA's Judiciary Committee, which is chaired by Leslie Johnson, is responsible for recommending to our board of directors TLTA's position on court decisions that could affect the defense of title companies and title agents.

Texas Realtors Publish 2020 Texas Homebuyers and Sellers Report

Texas homebuyers say that finding the right property is the most difficult part of the homebuying process, according to the 2020 Texas Homebuyers and Sellers Report released by Texas Realtors. The annual report provides insights into the demographics, motivations, and opinions of Texas homebuyers and sellers who had a real estate transaction between July 2018 and June 2019.
