TDI Commissioner Signs Rule Order Addressing 71 Agenda Items
Texas Department of Insurance (TDI) Commissioner Julia Rathgeber has signed a final order on agenda items heard in the Feb. 28, 2012, Rule Hearing. Most of the changes will go into effect on Jan. 3, 2014, with the exception of the agent minimum capitalization requirements that become effective July 3, 2014. What's Changed? A Guide to the Order
There are several very significant changes including items addressing agency solvency requirements, agent licensing requirements, continuing education requirements and changes to rules and forms. Additionally, there are many housekeeping items. TLTA has prepared this guide to help you navigate all of these changes. The guide categorizes all the Basic Manual changes and provides a brief description of each agenda item and a link to the full text. As a reminder, in March 2012, the Commissioner issued a separate order on withdrawn and disapproved agenda items, which you may view here.

TDI Schedules Informal Public Meeting Prior to November Southern Title Recoupment Fee Hearing
The Texas Department of Insurance (TDI) has issued notice of an Informal Public Meeting to take place Monday, Oct. 21, at 2 p.m. at the TDI Building in Austin. The purpose of this informal meeting is to take stakeholder input prior to the Nov. 15 hearing regarding the recoupment fee to be charged in connection with the failure of Southern Title Guaranty Company.

TLTA will represent the industry at this public meeting and provide input to TDI regarding the method of setting and collecting the fee. For planning purposes, a fee will be set after the November hearing and agents will be required to collect it in a similar manner to the guaranty fee, beginning early in 2014.

It is also important to note that although this is referred to as a "rate hearing," the purpose of the November hearing is to simply establish the amount to be charged for a guaranty assessment recoupment fee in connection with the failure of Southern Title Guaranty Company and not to review the basic premium rate.
