This presentation will address Durable Powers of Attorney (DPOA). DPOA
are frequently used to close real estate transactions, and the title industry
is requested to accept their use. This, of course, involves the
delegation of authority from a principal to an agent, and it is a prime area
for fraud and misuse. Moreover, the Texas Legislature has adopted
provisions in the Estates Code that require acceptance of DPOA unless specific
timelines and procedures are followed, and a permitted reason exists to decline
the DPOA. The DPOA may be old or in a foreign language, for instance.
This presentation will discuss the DPOA, the applicable statutory provisions,
proper handling, and steps to avoid incorrect usage and assure a valid closing
and title insurance transaction.
