Guaranty Fee Increasing to $3 Starting Oct. 1, 2026

Plan ahead to be compliant: Guaranty Fees must be collected at closing and remitted to TTIGA on a quarterly basis

The Texas Title Insurance Guaranty Association (TTIGA) announced that the Guaranty Fee will increase from $2 to $3 starting Oct. 1, 2026. TTIGA gives notice to all Texas title agents to collect an increased Guaranty Fee charge from the purchasers of each owner and lender title insurance policy issued in the state, beginning with closings after September 30, 2026.

Who pays the guaranty fee and who submits it?

The consumer purchasing owner and lender title insurance policies pays the fee, which is shown on the settlement statement and collected by the title agent at closing.

The title agent remits the fee to TTIGA on a quarterly basis using the Policy Guaranty Fee Remittance Form (Form TG-1).

Who is TTIGA? What do they do?

TTIGA is a non-profit, unincorporated association of all Texas-licensed title insurance companies governed by a board made up of title industry and public members appointed by the Texas Commissioner of Insurance. It exists to protect Texas title insurance policyholders and claimants when a title insurance company or title agency is designated as impaired by the commissioner of insurance. 

TTIGA collects the policy guaranty fee from title insurance transactions to fund the title insurance agent audit function of the Texas Department of Insurance and to fund the costs associated with insolvency of a title agent.
