Cyber Insurance: 10 Tips and Traps

Risk Management Magazine | Feb. 3, 2020
As businesses know, a network failure can shut down operations for extended periods of time and data breaches can expose customer information to third parties, potentially subjecting the breached company to class action litigation and regulatory penalties.

The insurance industry has responded by developing cyber insurance specifically designed to address losses resulting from problems with networks and computer systems. Insurers have also taken steps to limit coverage for such losses under more traditional policy forms, like commercial general liability (CGL), directors and officers (D&O) and property insurance. Policyholders should know that cyber insurance comes in many forms, and they can and should shop around and negotiate for the coverage that best suits their needs.

Here are 10 tips and traps for policyholders to consider when purchasing cyber insurance:
  1. Know What Is Available
  2. “Loss” of Data vs. “Misuse” of Data
  3. Regulatory Investigations
  4. Retroactive Dates
  5. What Are You Promising to Do?
  6. Choice of Counsel and Vendors
  7. “Network” Definition
  8. Coverage for Vendor and Rogue Employee Misconduct

Next Gen: Title Industry Leadership Today, Tomorrow and Beyond

TLTA President Mike Savas challenged our industry to focus on identifying and growing the next generation of industry leaders. His charge is a renewal of commitments this industry made more than a decade ago to further crucial industry priorities, including enabling women in leadership roles and ensuring the sustainability of the industry's continued prosperity.

Today we are proud to highlight another leader among the 'Next Gen' professionals who are stepping up to serve our industry via the advancement of ideas and innovations that benefit consumers, our industry and our state's powerful real estate economy.

Patrick Rose, President of Corridor Title in Dripping Springs, is a former Texas legislator who served as Chairman of the Texas House's challenging Health and Human Services Committee. He currently serves on TLTA's Legislative Committee, and he is a member of TLTAPAC's Board of Trustees.

Patrick Rose
  • Former Texas Legislator
  • Former Chair, Texas House Committee on Health and Human Services
  • TLTA Legislative Committee
  • TLTAPAC Board of Trustees

How did you get started in the industry?
I was looking to start a business within the real estate sector in the Austin – San Antonio Region, and decided on the Title Industry after much thought during the 2009-2010 timeframe. I entered the industry by acquiring the assets of an existing Title Agent, located in Dripping Springs, in October 2010.

What’s the best way to succeed in the title business?
I believe that success in our industry, and any industry for that matter, is based squarely on the success and empowerment of our valued colleagues and valued clients. At Corridor Title we are passionate about their respective success and opportunity – and if both of those critical groups succeed, so will Corridor Title.

What advice would you give other young professionals?
Your involvement with TLTA is not only important to the success of our industry, it’s important to your success as an industry professional. And the professional staff at TLTA does such a superb job of providing avenues for involvement – take advantage of the opportunity!

What book is on your nightstand right now? Or, what podcast are you listening to?
Simon Sinek’s Leaders Eat Last.

The title business can be fast paced and stressful. How do you unwind and stay balanced?
Family and civic involvement. My wife and I have two boys, and they are at terrific ages – 6 and 4.
